What is an LPA?

A Lasting Power of Attorney is a way of empowering someone that you trust with the legal authority to act on your behalf if, at some time in the future, you may not have the mental capacity to make decisions for yourself. The LPA may be concerned with personal welfare or financial and property affairs.

Your attorney can have power to pay bills, buy, sell and maintain property and control your investments with an LPA covering financial and property. An LPA covering your personal welfare would only be applied if you lose the mental capacity to make decisions about, for example, your medical treatment or where you live.

The Types of Power of Attorney

There are two primary types of power of attorney in the UK: “ordinary” and “lasting.” An ordinary power of attorney is typically used for temporary or specific purposes, such as managing financial matters while the donor is abroad. In contrast, a lasting power of attorney (LPA) remains valid even if the donor loses mental capacity and can no longer make decisions for themselves.

LPAs are commonly used for health and welfare decisions as well as property and financial affairs, providing individuals with the peace of mind that their interests are protected, even if they become unable to advocate for themselves. It’s important to note that setting up an LPA involves a formal legal process, and the donor must have the mental capacity to make the decision at the time of creation.
